On the courts

Out-of-Control Courts

Leftist judges aren’t doing these gymnastics in just gun cases. Judge Boasberg is turning backflips in immigration cases where he doesn’t even have the authority to rule. Welcome to NewSpeak, where up is down.

. . ."For example, Congress explicitly ordered that immigration cases have to go through immigration courts. The appeal from those courts is through the Circuit Court of Appeals, bypassing petty tyrants such as James Boasberg, who, if you’ve been listening, isn’t on an Immigration court. He’s a judge in a District Court, the level that Congress said should never see an immigration case. There’s also good authority that, when it comes to alien enemies, the courts are out of the picture entirely. But the Supreme Court sits on its thumbs." . . .

But:...Supreme Court Vacates Judge Boasberg’s TROs As To Tren de Aragua Under Alien Enemies Act   . . ."I’d call this a partial win for the government. The desire to whisk TdA members out of the country will be subject to judicial review, though it’s unclear what that will look like. At a minimum, the detainee will get to argue that he is not a member of the gang and the government likely will have to prove (not sure by what standard) that the person is a TdA member. So this is likely to slow down the process.

"But at least the case is away from Judge Boasberg and future district shopping in detainee cases will be difficult.

. . ."6/ Last week, Boasberg strongly signaled he was going to find probable cause existed that Trump Administration violated his order. I doubt SCOTUS' decision will shake Boasberg from that…my gut is the attacks on his daughter destroyed any judicial restraint he had.

But can a Judge who never should have had the case in the first place and whose order (turn the planes around) was grossly improper hold someone in contempt for not complying with the order?

Major victory from SCOTUS in Trump deportation case  . . ."Several aspects of this decision should reasonably be seen as encouraging in this ongoing clash between the Judiciary and the Executive, including the fact that the chief justice came down on the side of the conservative wing  of the Court, the fact that Judge Boasberg has been well and truly removed from at least this part of the battle, and the fact that there is at least a small light of clarity being shown by the High Court, indicating that it is ready to start reining in some of the lower courts.

"One can only hope that its next pronouncement will spell the end of the use of totally illegal and unconstitutional “nationwide” injunctions, which have no legal basis whatsoever.

"The opinions of the Court can be found here." . . .

Where were all the ‘protesters’ during Biden’s years in office?

 Jack Hellner

They claim that Trump is against free speech, but didn’t mind when parents were silenced at school board meetings and when the White House and Justice Department colluded to claim these parents were domestic terrorists.

"Most of the media act like all the protests erupting against Trump, his team, and his policies are spontaneous—but where were these people the last four years while Joe Biden was running the nation into the ground? These journalists have no curiosity, or investigative bent, as to who sponsors and pays for the protests—nor do they care.

"These protesters seem to have a lot of grievances on the issues, so I am curious as to why the protests never occurred when Biden was doing the very things for which they now protest Trump.

"They claim they want politicians to follow the laws that Congress passed, but never protested Biden, or sanctuary cities and states when they didn’t follow the law.Why didn’t they protest when the Biden Justice department failed to arrest all the people who vandalized and attacked Catholic churches and crisis pregnancy centers?

"They protest deaths from guns, but didn’t seem to be bothered by the thousands who died trying to make it across the border because Biden didn’t enforce the law. They also celebrate the shooting death of the United Healthcare CEO.

"They claim they care about children who are separated from parents, but did they raise a stink when the Biden administration lost track of over 300,000 children?

"They don’t even protest when illegals take jobs from citizens and lower wages, especially for minorities.

"The protesters are mad about federal workers being let go, but they didn’t protest when Biden and others dictatorially ordered that they take an experimental “vaccine” or get fired."...

"They protest that Musk is an unelected bureaucrat and shouldn’t essentially be doing anything, yet they don’t protest when unelected bureaucrats make rules and spend massive amounts of money not specifically authorized by Congress. They also haven’t complained that unelected bureaucrats were essentially running the White House while Biden was sleeping. They haven’t even raised concerns that people with autopens were signing all sorts of things instead of Biden."

The ‘Hands Off’ Ignorance

 The American Spectator

Here sits the American people, most doubtless blissfully unaware that were Democrats and the larger American Left to get their way in opposing President Trump and Elon Musk, their Social Security benefits would, in fact, be in trouble down the road.

"And, no surprise, this latest anti-Trump protest has things exactly backwards.

The New York Post headlines: “Anti-Trump protesters descend on DC to rally against Musk’s DOGE cuts, new tariffs: ‘Let’s keep them afraid!’”

"These stories were all over the media. The NY Post version reports:

Tens of thousands of protesters descended on D.C. Saturday as part of nationwide “Hands Off!” rallies against spending cuts from Elon Musk’s Department of Government Efficiency and President Trump’s new “Liberation Day” tariffs — with one speaker calling on the crowd to make the two men “afraid.”

The huge crowd assembled with homemade — and in many cases vulgar — anti-Republican signs near the Washington Monument while similar events unfolded in New York City, Los Angeles and Philadelphia.

“Trump and Musk, who want to be dictators and want to be kings and lords, they are afraid of the power of love and truth and justice!” declared activist minister William Barber II, who was one of the first speakers at the D.C. event.

“ 'They are afraid of your unity and diversity. Well, let’s keep them afraid until they change,” he roared. “This is an outright battle for civilization! We are not going to bow to power drunk neofascist extremists.”

"Unsurprisingly, the “Hands Off” groups have it exactly backwards. (And they were here in my area of Harrisburg, Penn., on the steps of the State Capitol.)

"Now, as has been true throughout a good bit of American history, it is the Left that is in reality “power drunk neofascist extremists.” The “activist minister” quoted in that Post is a longtime Leftist, William Barber II.

"Protest, of course, is an all-American and decidedly cherished First Amendment value. So no problem there.

"But to protest means that the subject of the protest should be examined, and examined closely. And in this case, the “Hands Off” crowd has it exactly backwards.

"Here’s a fact. A hard fact." . . .

Cheered on and led by the likes of Jamie Raskin, Eric Swalwell, and Corey Booker plus others. Congress's "best and brightest" are what we all need, yet we get these shallow, uninformed demagogues. Pray for Israel. TD

Jasmine Crockett Made Another Awful Comment on Race, Immigration

  Rebecca Downs

Crockett herself has made race her identity, as she went viral last week for comments during a House committee hearing that she was hired as a public defender despite having no criminal defense experience because as she told her boss, it was "because [she's] black."

"Rep. Jasmine Crockett (D-TX) has been in the news quite a bit for racist comments as well for her comments on immigration. She hasn't stopped and it doesn't look like she'll stop any time soon. It didn't take long for comments of hers that she made at the 125th anniversary event at Grace Baptist Church in Waterbury, Connecticut on Sunday to have her trending once more over X.

. . ."Last month, Crockett also made headlines for participating in an event that took place the same day as President Donald Trump's speech before a joint session of Congress. During the "24-Hour State of the People Marathon," a virtual event meant to serve as a protest, Crockett claimed that Republicans are cracking down on illegal immigration because Trump wants to make black people "go back to the fields!' Supreme Court lifts order blocking Trump from using Alien Enemies Act to deport suspected Venezuelan gang members

NY Post

The Trump administration will be allowed to resume deporting suspected Venezuelan gangbangers under the 1798 Alien Enemies Act after the Supreme Court on Monday lifted a lower court order that blocked the deportations.
"In a 5-4 decision, the high court ruled that the Trump administration was “likely to succeed on the merits” in a lawsuit filed in a Washington, DC district court challenging the removal of five Venezuelan men under the centuries-old law.
" 'The detainees are confined in Texas, so venue is improper in the District of Columbia,” read the conservative majority opinion." . . .
. . ."The court also determined that anyone the Trump administration is seeking to deport under the Alien Enemies Act must be afforded notice “within a reasonable time and in such a manner as will allow them to actually seek [a court hearing] in the proper venue before such removal occurs.”
. . ."“For all the rhetoric of the dissents, today’s order and per curiam confirm that the detainees subject to removal orders under the AEA are entitled to notice and an opportunity to challenge their removal,” the opinion continued. “The only question is which court will resolve that challenge.”
DC District Court Chief Judge James Boasberg had blocked President Trump from invoking the rarely used wartime law last month, and later extended his temporary restraining order until at least April 12.
"The Trump administration filed an emergency request with the Supreme Court to review Boasberg’s pause on March 28, after a divided three-judge panel on the DC Circuit Court of Appeals rejected a request to lift the stay as litigation plays out."

It's Hard Not to Snicker As Dems Float Idea of 'President Booker' After Pointless Speech

Bob Hoge; RedState

Cory Booker's sad stunt epitomizes Democrats' empty agenda  "
Sen. Cory Booker’s pointless imitation filibuster epitomizes Democrats’ pathetic incoherence in the wake of last November’s defeats.
"The New Jerseyan took to the floor not to achieve something, or even to oppose anything in particular, but as a stunt to symbolize how these are not normal times.

"Which, actually, nobody who paid any attention denies.

"The self-promoting, 25-hour marathon drew a few curious viewers online, and might have spoken to those in the party’s left-wing base who are still fuming that Senate Minority Leader Chuck Schumer (D-NY) didn’t force a government shutdown last month.

"But it did nothing to thwart the Senate GOP majority or slow the Trump agenda." . . .

"Cory Booker changed the course of political history the way Frank Luntz changed the course of men's toupees.  — PoliNater (@NaterPoli) April 2, 2025

"OMG. the really sad part is, he is pretending to be serious.

"No one is going to remember Cory Booker’s filibuster stunt in a week. Luntz’s comments on this are simply laughable."

Federal judge orders bombs removed from Tesla dealership to be put back and detonatedThe headline is more serious than the article itself TD

No, the House Should Not Impeach Judge Boasberg Over His Tren de Aragua Restraining Order I'd prefer a different opinion but respect and honor Professor Turley's wisdom. TD
. . ."GOP members are making a mistake in engaging in the same impeachment craze that took hold of the Democratic members in prior years (and continues this year). The way to respond to such rulings is to appeal them, not to try to remove judges (which is neither warranted nor likely).
"One of the greatest abuses of the Democratic party in the past eight years has been their use of impeachment investigations and charges against their political opponents. From President Donald Trump to conservative justices, liberal members have demanded impeachments over everything from opposing the NFL kneelers to hanging revolutionary-era flags.
"Now, some Republican members (and Elon Musk) have joined this frenzy in calling for the impeachment of judges who ruled against Trump’s earlier executive orders and programs. Elon Musk has supported this effort.
"The Trump Administration was fully aware that the executive proclamation invoking the use of the Alien Enemies Act to detain and deport members of Tren de Aragua would be controversial. While the Administration believes that it can establish the legal basis for such use of the largely dormant law, the issuing of a temporary restraining order within hours of the EO was not unexpected. We expect an expedited and intense appeal process to now unfold.
"The Alien Enemies Act is best known as one of the notorious Alien and Sedition Acts of 1798 used by the Adams Administration. I discuss the abuse of those acts in my book, The Indispensable Right: Free Speech in an Age of Rage.”
"The case presents a number of novel issues. First, as a threshold matter, is whether a presidential determination of the underlying criteria is even reviewable by the federal courts. Some argue, and the Trump Administration is likely to assert, that this is a political question that is heavily laden with international and national security determinations." . . .

Why Do Democrats Love Violence?

 Power Line blog

"The coordinated attacks on Teslas, Tesla drivers and Tesla dealers represent one of the most appalling political developments of recent years. These attacks are coordinated, organized and financed: yesterday was proclaimed a “global day of action” by the “Tesla Takedown” movement. CNN found the violence exciting.

"As do, apparently, 100% of Democratic politicians. I hadn’t seen any Democratic officeholders condemn the violence, so I thought I must have missed it. But no: the Google search “Democrats condemn Tesla attacks” turns up zero instances of any such criticism.

" 'Today, Senate Democrats made it official that they support arson, firing of bullets into Tesla dealerships, and violence and threats of violence against Tesla drivers. Tennessee’s Marsha Blackburn introduced a resolution condemning the anti-Tesla violence. It contained nothing that any reasonable person could object to:

Now, therefore, be it

Resolved, That the Senate condemns the horrific acts of violence, arson, and domestic terrorism committed against electric vehicles, car dealerships, and charging stations throughout the United States.

"But it was too much for Democrats to swallow: they killed the resolution.

"Democrats have a long history of using violence and threats of violence to achieve their political goals, going back to the Ku Klux Klan, and beyond. Today’s vote, and the resounding silence of every Democratic politician in the face of domestic terrorism, represent a disgusting continuation of that tradition."

Tony Branco

Jonathan Turley: It is Not “Karma,” It is a Crime: The Curious Silence Over Political Violence in New York  . . ."I get the sense of karma as the woman does a face plant on the subway platform while trying to continue her attack on the fleeing individual.

"However, this should be neither funny nor acceptable. It is political violence and the woman appears to believe that she has a license in New York City to assault anyone wearing a MAGA hat.

"This is where what I call “rage rhetoric” turns into political violence. As I wrote in my book, “The indispensable Right,” that is the curious aspect of rage:

“What few today want to admit is that they like it. They like the freedom that it affords, the ability to hate and harass without a sense of responsibility. It is evident all around us as people engage in language and conduct that they repudiate in others. We have become a nation of rage addicts; flailing against anyone or anything that stands in opposition to our own truths." . . .

. . ." When did political violence become just a cost of riding the subway for conservatives or libertarians? The lack of outrage shows how this age of rage has dulled our senses to such extreme conduct. This is about conduct not speech. When this person went from raving to assault, she crossed over into the criminal code. The problem is that such protections are only meaningful if New York prosecutors and police are prepared to enforce them." . . .

Humor: People who want to tax cow farts are upset about Trump’s tariffs

GENESIUS TIMES  "WASHINGTON, DC—Green New Deal Democrats are reportedly fuming over President Trump’s latest tariff announcements—not because of trade imbalances or economic fallout, but because they’re worried it’ll hurt their grand plan to tax cow farts. Yes, you read that right: the party that once dreamed of a world powered by windmills and fueled by kale smoothies is now locking horns with the MAGA king over bovine flatulence.

"The controversy kicked off when Trump, fresh off his re-election landslide, unveiled a new round of tariffs aimed at curbing imports of cheap foreign beef. “America’s cows are the best cows—tremendous, really—and we’re not letting those sneaky foreigners undercut our ranchers,” Trump bellowed at a rally in Texas, flanked by a herd of suspiciously patriotic-looking Holsteins draped in tiny American flags. The move, cheered by cattle ranchers and steak enthusiasts alike, sent shockwaves through the progressive wing of the Democratic Party, who saw it as a direct attack on their eco-utopian agenda.

"At the heart of the outrage is the Green New Deal’s lesser-known “Methane Mitigation Initiative,” a proposal floated by Rep. Alexandria Ocasio-Cortez (D-NY) to slap a tax on livestock emissions—chiefly, the potent greenhouse gas expelled from cows’ rear ends. “We’re talking about a climate crisis here,” AOC declared at a press conference, holding up a chart of a cow with arrows pointing to its hindquarters. “Every moo is a ticking time bomb, and every fart is a call to action. But now Trump’s tariffs are going to flood the market with untaxed American cow gas!” . . .

Protests for Dummies

 Larry Brandes

"It is with shock and awe that protests are breaking out across America filled with angry liberals dancing “The Electric Slide” and carrying signs. I still remember the Vietnam protests of 1968 which in retrospect, made sense.  Old guys in Washington waged war with Vietnam and 58,000 young men died horribly in fetid swamps never understanding exactly what they were doing there in the first place. I always remember those protest signs: “Hey, hey LBJ, how many kids have you killed today?”

"Rallies today are confusing and participants evidently don’t know exactly what they are protesting. We get that they are angry, but they aren’t exactly standing on a barricade singing “One More Day.”  Instead, these protesters are burning Teslas, polluting the environment and screaming “Hands Off!”  Apparently they are really mad at The Department of Government Efficiency (DOGE) which was tasked with finding fraud and government waste. As a testament to their anger, leftists proudly wave the following signs:

"Hands off our illegal immigrants.  We want gang bangers, rapists, murderers, pedophiles and miscreants in our society—well not in our community and certainly not as our neighbors, but somewhere.  It’s only right. Which reminds me of the invasion of Martha’s Vineyard.  One bright day, 50 (f-i-f-t-y) immigrants arrived and walked right by their town sign that proudly proclaimed:

ALL ARE WELCOME HERE.  WE STAND WITH IMMIGRANTS.

"Affluent residents panicked, declared Defcon 5 and called out the National Guard.  Those huddled masses who washed up on their shore were quietly removed within 24 hours to parts unknown. Judge Boasberg didn’t bang his gavel and insist on their return.

"Hands off our education.  How dare you mess with our crack education system that has spectacularly failed countless generations of students?  Students graduate from poor high schools illiterate and needlessly impeded from achieving success in life.  Wealthy kids get to attend premier public and private schools and graduate with golden tickets to attend upper tier colleges and universities.  Leave those underperforming schools alone and make sure that superintendents and administrators are paid big bucks to maintain the status quo." . . .

Trump Is the Only One Taking Antisemitism Seriously

The American Spectator

"The Democrats today try to call Trump’s actions extreme. However, if you’re a Jewish student aware of what’s happening — from violent protests on Ivy League campuses to overt antisemitism misrepresented as activism — you understand that strong action is not extreme. It is necessary."

"As a young Jewish American, I have always been proud of my family’s history and perseverance: some members of my family survived the Holocaust, others escaped Soviet oppression, and almost all rebuilt a life in America with little other than determination and faith. Their stories taught me early on that freedom is fragile — and that you have to fight to protect it.

"'Now, as I prepare for college, I see antisemitism rising in places that are supposed to be civilization’s great centers of learning and intellectual freedom. Recent reports indicate that antisemitic incidents on college campuses are increasing, affecting real students who face harassment, threats, and even violence simply for being Jewish. This reality has shaped my political views and made me appreciate leaders who don’t just talk about protecting minorities — they actually do it. That’s why I support President Trump.

" 'President Trump’s actions against antisemitism are real, not symbolic. Under his direct leadership, his administration made it clear that colleges and universities will lose federal funding if they allowed antisemitism to flourish. Schools had a choice: take meaningful steps to stamp out anti-Jewish harassment, intimidation, and violence or face serious consequences. Columbia University, the University of Pennsylvania, Brown University, and Harvard University, among others, have been explicitly warned that inaction would lead to a loss of federal support, ensuring that Jewish students could attend campus without fear.

" 'Earlier, in his first term as president, Trump also strengthened protections under Title VI of the Civil Rights Act. For the first time, antisemitism was formally recognized as a violation of civil rights on college campuses. Previously, universities could overlook antisemitic harassment, but now they can be held legally accountable.

" 'Beyond the campus, Trump’s Department of Justice established a task force dedicated to fighting antisemitic hate crimes. Working closely with local law enforcement and community groups, this task force has led to a notable increase in hate crime prosecutions related to antisemitism — data from official reports indicates a significant rise in cases compared to previous years.

" 'When it comes to immigration, Trump is taking a tough but fair stand. He made it clear that foreigners on student visas who participate in antisemitic hate could be deported. The Democrats label this approach as harsh, but I call it common sense. If you come to this country to spread hate and division, you don’t belong here. The United States should welcome people who respect its values — not those who seek to destroy them." . . .

Greta Thunberg named 'Antisemite of the Week' by Jewish advocacy group

“She has sadly transformed her activism into a platform for vile Jew-hatred,” the organization added.

She joined pro-Palestinians just days after Oct. 7, posting a photo of herself holding a sign reading “Stand with Gaza” — alongside a toy octopus, which some read as an allusion to the Nazis’ antisemitic propaganda visualizing Judaism’s supposed network of control over the world.

"Thunberg — who is autistic — later removed the photo and claimed she was “completely unaware” of the historical use of antisemitic octopus imagery and clarified she meant for it to represent her emotions."

"“The toy in the picture is a tool often used by autistic people as a way to communicate feelings,” she said.". . .

Barack Obama Says He Was in a ‘Deep Deficit’ With Michelle During White House Tenure

RTM

Despite the challenges, the Obamas have remained married for over three decades. Their story has often served as a source of inspiration, but recent disclosures add nuance to that narrative.

"Former President Barack Obama acknowledged that his time in the White House placed a significant strain on his marriage to Michelle Obama.
"Speaking candidly during a conversation with Hamilton College President Steven Tepper on April 3, Obama revealed that he was “in a deep deficit” with Michelle after serving two presidential terms.
"Obama’s remarks came as he reflected on life after the presidency. When asked about his current routine, he said he now splits his time between working on the Obama Foundation and writing the second volume of his presidential memoirs.
"The foundation, which he and Michelle founded, is dedicated to training new leaders in the U.S. and abroad." . . .". . .In a moment of personal reflection, Obama joked that he was trying to make up for lost time with Michelle by “doing occasionally fun things,” according to Mint.

"His comments echoed previous admissions that his years as president had tested their relationship." . . .
