Kyle Rittenhouse's Call of Duty Habit and Post-Arrest Silence Aren't Evidence of His Guilt    . . . "But there was another courtroom fixture centerstage on Monday: Assistant District Attorney Thomas Binger, who—no matter how you feel about Rittenhouse—should serve as a reminder of just how pitifully low prosecutors will stoop while in pursuit of a conviction.

"Binger's Rittenhouse cross-examination should have been a big moment, which it was, but not for the reasons Binger would have hoped. He began with a probe of Rittenhouse's interest in purchasing an AR-15, asserting that Rittenhouse must have declined a pistol or a shotgun because of his Call of Duty habit. There are a few problems here: Players use many different sorts of guns in simulation games, including pistols and shotguns. But more fraught is the implication that playing violent video games somehow makes you a murderer, or more likely to murder someone—a hysterical assumption that is not based on fact.

"The questioning was desperate, but it quickly moved from breathless to potentially unconstitutional as Binger faced off multiple times with Judge Bruce Schroeder after the former noted Rittenhouse's post-arrest silence with the insinuation that it somehow indicated his guilt.

" 'I was astonished when you began your examination by commenting on the defendant's post-arrest silence," the judge said. "That's basic law. It's been basic law in this country" for decades, adding, "I don't know what you're up to."

"Among the many accusations that have been leveled at Schroeder this week are wannabe member of the Klan, that he is the “worst judge in town,” and that he is attempting to parlay this trial into a “gig on FOX News or OAN, or whatever.” If, as seems eminently possible, Rittenhouse is acquitted of all the charges that have been brought against him by the state, one suspects that a lot of the resulting opprobrium will fall on Schroeder.
"Which would be ludicrous, because Bruce Schroeder is in fact none of the things that his critics have proposed. Instead, he’s a liberal. 
"I use that word favorably. As the Washington Post notes in a recent profile, Schroeder is “a jurist who believes trials can be too easily manipulated, particularly by the prosecution.” Or, as Slate’s Jeremy Stahl puts it, Schroeder has a reputation for being “generally more favorable to defendants than many other judges.” Why has Schroeder conducted the trial in the way that he has? Because that is how he always conducts trials. It has nothing to do with some preposterous wish to help Rittenhouse, or with some secret desire to defend the Second Amendment, or with some longshot play to replace Tucker Carlson in the 9 p.m. hour. Schroeder is a liberal on matters of criminal justice, and this is how liberals on matters of criminal justice tend to judge." . . .

New Jersey Democracy Died in Darkness?

 But with this lament, they have told us all they can't imagine voters making a decision without heavy influence from the media, and the decision to dump a powerful Democrat is somehow a failure of local journalism.

"Take Sen. Stephen Sweeney, the powerful Democrat leader of the state Senate in New Jersey. Absolutely no one thought he would lose to a Republican who was a trucker and had a tiny campaign treasury.
" Paul Farhi, a veteran media reporter at the Post, diagnosed the problem in a story headlined, "How the media missed a New Jersey senate candidate's racist social media posts -- until he'd already won." A more accurate headline would be, "How the media failed to help a Democrat win (because no one thought he would lose)."
" Farhi insisted Ed Durr "had a history of posting bigoted, misogynistic and derogatory comments on social media." Like what? None of Durr's tweets were quoted in full by Farhi, and Durr quickly deleted his Twitter account, so a lot of context is missing.
" No. 1: "Mohammed was a pedophile!" he tweeted in 2019, and also described Islam as "a false religion" and "a cult of hate."
" Mohammed, according to Islamic writings, married a 6-year-old child bride. But the Post seems upset that Islam is being criticized at all. Is it "racist" or "bigoted" to say there's such a thing as a "false religion"? Muslims believe other faiths are false, to put it mildly. Christians believe other faiths are false. That's why they have their own faiths. "Cult of hate" is harsh, but it sounds pretty close to how the Post describes die-hard Trump fans.

BLM leader threatens ‘riots, fire, bloodshed’ in NYC if Eric Adams gets tough on crime

NY Post  "A Black Lives Matter leader vowed there’ll be “riots,” “fire” and “bloodshed” if Mayor-elect Eric Adams follows through with his promise to bring back plainclothes anti-crime cops to battle New York’s surge in violent crimes.

"New York BLM co-founder Hawk Newsome debated the plan for a return to tougher policing with Adams during a contentious sit-down at Brooklyn Borough Hall Wednesday that was livestreamed on Instagram.

"Although Adams found common ground with the activists on plans to fight poverty in the black community, the former NYPD captain said he’ll be reinstating a revamped version of the undercover anti-crime unit that was disbanded at the height of widespread police protests last year.

" 'If they think they are going back to the old ways of policing then we’re going to take to the streets again,” New York BLM co-founder Hawk Newsome said outside Borough Hall after the meeting." . . .
